Lesson Agreements & Liability Policy
Assumption of Risk:
By booking lessons or camps (services) I understand that 505 Swimming LLC and its agents, employees, and assigns is/are not and shall not be responsible for or liable for any illness, death, injury to person or damage to property arising from, related to, or resulting from the swim lessons or camp sessions provided and the I hereby forever release, discharge and holds harmless 505 Swimming LLC and its agents, employees, and assigns from any and all claims, liabilities, suits, and/or damages of any kind that the undersigned, the swimmer, and/or his/her heirs, administrators, representatives, executors or assigns have, may have or claim to have resulting in any way from his/her participation in said program(s).
Quality of Services:
I also understand, acknowledge, and agree that 505 Swimming LLC makes no warranty as to the content or quality of such sessions (services) provided, which may vary at any time in the sole discretion of 505 Swimming LLC and its owners and/or employees.

Release of Liability:
In consideration of being allowed to participate in any way in 505 Swimming LLC’s lessons or swim camp sessions, its related events and activities, I acknowledge, appreciate, and agree that: The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and, I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself or my child from participation and bring such to the attention of 505 Swimming LLC or one of its instructors immediately; and, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS 505 Swimming LLC and its agents, employees, and assigns, and, if applicable, owners and lessors of premises used for the activity (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

Health Agreements:
In the event of a MEDICAL EMERGENCY or INJURY during the a swim lesson or swim camp session, every reasonable effort will be made to contact the emergency contacts provided on the registration form. However, if immediate contact cannot be established, our staff is AUTHORIZED to seek necessary medical attention for the participant. This may involve contacting EMERGENCY MEDICAL SERVICES or arranging for the participant's transportation to a MEDICAL FACILITY for further evaluation and treatment. Additionally, the PARTICIPANT'S PARENT or LEGAL GUARDIAN acknowledges and agrees to assume FULL RESPONSIBILITY for any COSTS incurred for MEDICAL CARE and TREATMENT provided to the participant. This includes, but is not limited to, expenses associated with AMBULANCE SERVICES, HOSPITALIZATION, MEDICATIONS, or any other MEDICAL SERVICES required.

Code of Conduct:
PARTICIPANTS in the swim camp are expected to adhere to a CODE OF CONDUCT that fosters an environment of RESPECT, CONSIDERATION, and INCLUSIVITY towards fellow participants, instructors, and lifeguards. DISRUPTIVE or DISRESPECTFUL BEHAVIOR that interferes with camp activities or compromises the SAFETY or FOCUS of others WILL NOT BE TOLERATED. This includes, but is not limited to, the misuse of POOL EQUIPMENT and the failure to comply with the RULES and INSTRUCTIONS provided by the lifeguards. At the DISCRETION of our instructors or facility lifeguards, participants may be REQUESTED to take a BREAK from camp activities if their behavior hinders a PRODUCTIVE and SAFE group environment. REGISTRATION for the swim camp is CONTINGENT upon the participant's ABILITY to BEHAVE APPROPRIATELY and FOLLOW the camp's CODE OF CONDUCT. We reserve the right to REFUSE or CANCEL the registration of any child whose behavior poses a RISK to the WELL-BEING or ENJOYMENT of other participants.

Cancellation Policy:
SWIM CAMP sessions MUST BE CANCELLED NO LATER THAN 5:00 PM on the FRIDAY BEFORE the FIRST DAY of camp. SWIM LESSON sessions MUST BE CANCELLED NO FEWER THAN 48 HOURS PRIOR TO THE START OF THE LESSON. This deadline allows us to make necessary arrangements and offer vacant spots to other interested participants. The CHARGED AMOUNT of any camp or lesson registration is NON-REFUNDABLE, and there will be NO EXCEPTIONS or REFUNDS GRANTED for services that are NOT CANCELLED BEFORE the specified deadline.

Late Pickup Policy:
AT THE CONCLUSION OF EACH CAMP or LESSON SESSION, it is imperative that children are promptly picked up by their PARENT or LEGAL GUARDIAN. We reserve the right to REFUSE REGISTRATION to families who CONSISTENTLY VIOLATE this policy. Please be aware that our responsibility for the supervision and care of children only extends during the OFFICIAL CAMP OR LESSON HOURS. While we will endeavor to ensure the safety and well-being of the child in the event of a late pickup, WE BEAR NO RESPONSIBILITY for their welfare or safety AFTER the designated booked hours.

For Parents/Guardians of Participants of Minority Age
This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
